Online Dispute Resolution

Abstract:

Tato disertační práce je zaměřena na oblast alternativního i soudního řešení sporů pomocí online nástrojů a metod, kterou zahraniční odborné texty nazývají “Online Dispute Resolution” („ODR“), tedy řešení sporů online nebo online řešení sporů. Vychází ze základního principu, že řešení sporů online zahrnuje využití elektronických nástrojů při řešení nejrůznějších sporů (sensu lato). Jednotlivé ODR nástroje tedy lze použít v rámci jakýchkoli forem a metod řešení sporů. Implementací nástrojů a metod řešení sporů online přitom stávající i nové systémy řešení sporů mohou zvyšovat svou efektivitu a také umožnit přístup ke spravedlnosti subjektům, které by jej jinak neměly – ODR tak snižuje bariéry a zvyšuje dostupnost soudní i mimosoudní ochrany práv. Typickými případy jsou například spotřebitelské nebo bagatelní přeshraniční spory, spory pramenící z virtuálního prostředí nemající zřejmou protihodnotu anebo nepromítající se do nevirtuálního světa, nízkohodnotové spory s vysokou technickou specializací nebo typizované spory drobných subjektů s velkým smluvním hegemonem, které by bez ODR pro sporné strany byly prakticky neřešitelné. Tato práce dále popisuje vertikální recepci online nástrojů, které postupně z čistě virtuálních systémů existujících výhradně v kyberprostoru přebírají systémy alternativního řešení sporů („ADR“), zejména v podobě rozhodčího řízení. Následně pak jsou tyto nástroje implementovány také orgány státní správy a aplikovány v soudním řízení a dalších formách rozhodování sporné agendy státními orgány.

Abstract:

This dissertation thesis analyses alternative and judicial dispute resolution using online instruments and tools – online dispute resolution (typically abbreviated as ODR) or online redress. It is written on a principle notion that online dispute resolution involves the usage of electronic instruments and tools in all thinkable kinds of dispute resolution (sensu lato). The individual ODR tools can be utilized in any form, type and method of dispute resolution (in judicial litigation. alternative dispute resolution). By implementing the tools and methods or online dispute resolution, both traditional and new dispute resolution systems can increase its effectivity and broaden access to justice to indivividuals who would not otherwise have it. ODR therefore lowers the barriers and increases availability of both judicial and extra-judicial protection of individual rights. Specificaly, this applies to cases including but not limited to consumer and small-claims cross-border disputes, disputes originating in virtual cyberspace reality that do not have any obvious and/or direct equivalent value in a material world or any effect to material world at all, low-value disputes requiring extremely high technical qualification or standardized disputes with high volumes of petty disputants who stand against a corporation in a position of contractual hegemony, all of the disputes and many others that would effectively have no real solution without ODR. This paper also describes a finding of a vertical reception of online tools that gradually find its way from purely virtual cyberspace-only systems to alternative dispute resolution systems („ADR“), typically to abritration first. Consequently, the same tools tend to be implemented by the government institutions both in its judicial systems and other decision and resolution issuing government bodies.
