Abstract:

Tato disertační práce se zabývá tzv. obecnými režimy zacházení se zahraničními investicemi. Cílem práce není pouze teoretické vysvětlení a popis režimů zacházení obsažených v mezinárodních investičních instrumentech, ale rovněž i jeho aplikace v praxi, vycházející z analýzy rozhodnutí orgánů rozhodujících investiční spory. Vzhledem k tomu, že dosud neexistuje žádná mnohostranná univerzální smluvní úprava zabývající se mezinárodní ochranou zahraničních investic, spočívá jádro právní úpravy této problematiky ve dvoustranných smlouvách (dohodách) o vzájemné podpoře a ochraně investic a dále pak v dohodách regionálních. Vágní úprava obsažená v těchto dohodách však sama o sobě nedává odpověď na otázky týkající se obsahu a rozsahu jednotlivých režimů zacházení a odpovědi na tyto palčivé otázky je tedy nezbytné hledat téměř výhradně ve výsledcích rozhodovací činnosti. Tato práce je rozdělena do pěti kapitol, v nichž se postupně zabývám národním režimem zacházení, režimem nejvyšších výhod, mezinárodním minimálním standardem, režimem spravedlivého a nestranného zacházení a režimem plné ochrany a bezpečnosti.

Abstract:

The subject of this thesis is the treatment of foreign investments by the host-states. The goal of this thesis is not only a theoretical explanation and description of the treatment standards contained in international investment instruments but also their application in practice, as it is only in practice where the subjects of international investment law (the host state and foreign investor) can gain a closer insight into their legal rights and obligations. Since the rules contained in international treaties themselves do not answer questions regarding definitions of individual treatment regimes, it is necessary to look for their definitions almost entirely in investment case law. This thesis is divided into five chapters in which I am dealing with the national treatment, most-favored-nation treatment, international minimum standard, fair and equitable standard of treatment and full protection and security.
