Deep-seabed mining as an international regime

Abstract:

Bakalářská práce se zabývá mezinárodním režimem v oblasti těžby nerostů na dně oceánů. Hlavním cílem práce je identifikovat mezinárodní režim hlubokomořské těžby pomocí teoretické struktury režimu Stephena Krasnera a teorie environmentálních režimů Orana R. Younga. V první části práce je uvedena definice a charakterizace režimů, jakož i způsoby jejich vzniku a rozvoje. Druhá část se přímo zaměřuje na realitu hlubokomořské těžby, současné právní regulace a na Mezinárodní úřad pro mořské dno zřízený Úmluvou OSN o mořském právu pro dohled na činnost na mořském dně vně jurisdikce jednotlivých států. Ve třetí části je k identifikaci režimu na současná platná pravidla, předpisy a zásady těžby aplikována teoretická struktura režimu a charakteristika environmentálních režimů jako režimů spravujících životní prostředí.

Abstract:

The bachelor thesis deals with an international regime in the area of mineral extraction on the ocean floor. The main objective of the thesis is to identify the international regime of deep-sea mining using Stephen Krasner's regime theoretical framework and Oran R. Young's environmental regime theory. The first part of the thesis provides a definition and characterization of regimes, as well as how they emerge and develop. The second part focuses directly on the realities of deep-sea mining, current legal regulation, and the International Seabed Authority established by the UN Convention on the Law of the Sea to oversee seabed activities beyond national jurisdiction. In the third part, the theoretical structure of the regime and the characteristics of environmental regimes as environmental governance regimes are applied to the current rules, regulations and principles of mining to identify the regime.
