Concepts of international jurisdiction of national courts

Abstract:

Disertační práce se zabývá problematikou mezinárodní pravomoci národních soudů z hlediska zajištění práva stran soudního řízení na spravedlivý proces. Tato otázka je zkoumána v kontinentálním právním systému, za jehož reprezentanta bylo zvoleno nařízení Brusel I, a v právu USA jako představiteli angloamerického právního systému. V první části práce je vymezen pojem "mezinárodní pravomoc soudů", význam práva na spravedlivý proces a obecné principy formulace norem pro určování mezinárodní pravomoci soudů. Následně jsou zhodnoceny jednotlivé druhy mezinárodní pravomoci soudů ve světle práva na spravedlivý proces a otázka fora shopping. Druhá část práce je zaměřena na shody a rozdíly v pojetí mezinárodní pravomoci soudů a jejího odmítnutí v nařízení Brusel I a v právu USA z pohledu práva na spravedlivý proces.

Abstract:

The focus of this thesis is the jurisdiction of national courts in cases with foreign element(s) in light of the right of parties to a dispute to a fair trial. This issue is examined in the continental law system represented by the regulation Brussels I and in the Anglo-American law system represented by the U.S. law. In the first part of the thesis the term “international jurisdiction of courts” is defined. Then, the significance of the right to a fair trial and the principles of the formulation of the rules for determination of international jurisdiction of courts are explained. Further, the individual kinds of international jurisdiction and the issue of forum shopping are evaluated from the perspective of their compliance with the above mentioned components of the right to a fair trial. The focus of the second part of the thesis is to examine the convergences and divergences of the concepts of international jurisdiction and its refusal in the regulation Brussels I and in U.S. law, both in light of the right to a fair trial.
