The Right to Self-defence against Non-state Actors - the Clash between International Commitment to Maintain Peace and to Observe Human Rights

Abstract:

Tato diplomová práce se zabývá problematikou práva na sebeobranu proti nestátním aktérům se zaměřením na rozpor závazků státu k ochraně míru a závazků k ochraně práv svého obyvatelstva. Nejprve je popsána historie a vývoj práva na sebeobranu a zákazu použití síly v mezinárodním právu, a poté se práce snaží popsat základní mezinárodní povinnosti, které stát vůči svému vlastnímu obyvatelstvu má. Na základě těchto částí se poté zaměřuje na popis a analýzu současných rozporů ve vnímání práva na sebeobranu v souvislosti s nestátními aktéry, a to zejména na jeho restriktivní interpretaci a její udržitelnost ve vztahu k povinnostem státu vůči lidským právům svého obyvatelstva.

Abstract:

The thesis deals with the issue of a right to self-defence against non-state actors with the focus on the discrepancy of state’s international obligations to maintain peace and observe human rights of its population. In the first part, the history and the development of right to self-defense and the prohibition on the use of force is given, followed by the basic description of international obligations of state towards its own population. On the basis of these parts, the work focuses on the description and analysis of contemporary discrepancies in the perception of the right to self-defence in relation to non-state actors, more closely on its restrictive approach and its sustainability with the connection to the state’s duties towards human rights of its people.
