Long live the King!(?) The Possibility of Abandoning Republicanism under the Czech Constitutional Order

Abstract:

Tato diplomová práce se zaměřuje na materiální limity ústavodárce při přijímání ústavních zákonů. Jako teoretické předpolí je rozebráno roz-lišování mezi mocí ustavující a ustavenou, přičemž následně jsou důsledky tohoto rozlišování vztaženy na klauzule věčnosti a materiální ohniska ústav z hlediska jejich existence a normativní povahy. Nastíněné obecné principy jsou zároveň vztaženy na posuzování konkrétní změny z republikánské formy vlády na monarchii, a to v rámci současného ústavního pořádku České republiky.

Abstract:

This thesis focuses on the material limits of the constitution-maker in enacting constitutional laws. As a theoretical background, the distinction between constituent and constituted power is discussed, and then the implications of this distinction are related to the eternity clauses and basic structures of the constitutions with respect to their existence and normative nature. These general principles are also applied to the assessment of a concrete change from a republican form of government to a monarchy, within the current constitutional order of the Czech Republic.
