Action"K" Legal Assessment of the Eviction of Agricultural Families from the Land in the 1950th.

Abstract:

Práce ze zabývá problematikou trestněprávního postihu osob zodpovědných za vyhánění vesnických boháčů „kulaků“ z půdy v 50. letech minulého století v rámci tzv. akce „K“. V jednotlivých kapitolách jsou postupně rozebírány klíčové otázky této problematiky. Zejména otázka promlčení, otázka vypořádání se s amnestiemi prezidenta republiky, otázka retroaktivity zákona a zejména pak otázka subsumce příslušného jednání pod příslušná ustanovení trestního zákoníku.

Abstract:

The dissertation deals with the issue of criminal prosecution of persons responsible for eviction of “kulaks” or the rich peasants from their land in the 1950s under the so called Action “K”. Key questions of this issue are discussed in individual chapters. It means especially the question of statute of limitations, the question of amnesties of the President of the Republic, the question of retroactivity of law and especially the question of subsumption of the acts at issue under respective provisions of the Criminal Code.
