Requirements of a Bill of Exchange in Czech Republic and Selected Romanesque Countries

Abstract:

Předkládaná práce se ve své teoretické části zabývá obecnou charakteristikou systému směnečného práva se zaměřením na oblast obligatorních i fakultativních náležitostí směnky. Hlavním cílem je porovnat teoretický zákonný rámec předmětné problematiky s reflexí formální přísnosti v rozhodování jednotlivých soudů, které se snaží pomocí ucelené judikatury nadále udržet formálnost směnečných vztahů. Specifická povaha směnečných vztahů se také projevuje v jejich abstraktnosti, neboť směnečné vztahy lze posuzovat pouze z hlediska naplnění požadavků platné zákonné formy, bez vlivu kauzálních vztahů. Důraz je kladen především na objasnění povahy směnečných vztahů ve světle judikatury.

Abstract:

Theoretical part of the presented work deals with general characteristics of the law for bills of exchange and promissory notes with the focus on obligatory and facultative essentials of a bill of exchange and promissory note area. The aim is to compare theoretical legal framework of the particular issue with the the reflection of rigor cambialis in court decision making, where the courts seek to keep the formality of exchange relations.The specific nature of exchange relations is also demonstrated in their abstractness, for exchange relations can only be viewed from the perspective of fulfilment of legally valid requirements without the influence of causal relations The emphasis is directed on the clarification of exchange relations nature in the court decision-making area.
