Abstract:

Diplomová práce se zabývá problematikou sociální reprezentace zaměstnanců v českém pracovním právu, a to nejen z hlediska analýzy a zhodnocení současné právní úpravy, ale též z hlediska legislativního vývoje během posledních několika let. Práce také poukazuje na základní rozdíly mezi jednotlivými zástupci zaměstnanců. Skládá se z pěti hlavních částí. V úvodu je objasněna pozice kolektivního pracovního práva v rámci systému pracovního práva. Na úvod plynule navazuje první část práce, která pojednává ve dvou kapitolách o tom, jak se v průběhu doby vyvíjely kolektivní pracovní vztahy na našem území. Obsahem první kapitoly je porovnání významu kolektivních vztahů v minulosti a dnes. Druhá kapitola potom poskytuje ucelený přehled legislativního vývoje kolektivních pracovních vztahů během posledních několika let. V novém zákoníku práce, který vešel v účinnost dne 1. 1. 2007, byla ponechána celá řada ustanovení dávající odborové organizaci takové kompetence, které dle názoru pléna Ústavního soudu České republiky takové organizaci nepřísluší. Druhá část je věnována principu zastupování zaměstnanců v pracovněprávních vztazích. Tato část práce rozebírá různé typy zástupců zaměstnanců a jejich práva, která jsou pro větší přehlednost a možnost komparace rozdělena na ta, která náleží všem zástupcům zaměstnanců bez rozdílu, a na ta, jimiž disponují výhradně jen odborové organizace. Cílem této části je mj. definovat postavení odborové organizace jako jedné ze stran kolektivního vyjednávání reprezentující zaměstnance. Další kapitola je zaměřena na problematiku dalších zástupců zaměstnanců vedle odborové organizace, a sice radu zaměstnanců a zástupce pro oblast bezpečnosti a ochrany zdraví při práci. Na závěr této části je zařazeno shrnutí základních rozdílů mezi jednotlivými variantami zástupců zaměstnanců. Následující část práce rozebírá přístup zaměstnanců k nadnárodním informacím a projednáním. Jak napovídá její název, tato část detailně popisuje proces vzniku evropské rady zaměstnanců a objasňuje její funkci. Část věnovaná budoucímu vývoji právní úpravy zástupců zaměstnanců posuzuje vhodnost stávajícího právního řešení a poukazuje na některé mezery v právní úpravě. Současně předkládá některé návrhy de lege ferenda, čímž představuje určitý příspěvek do diskuze o problematice českého kolektivního pracovního práva. Pátá část práce je zaměřena na sociální politiku Skupiny ČEZ. Nejprve popisuje postavení odborových organizací v této společnosti, kde sociální smír je jednou z jejích priorit. Dále se snaží se přiblížit funkci a činnost odborů. Nabízí seznámení s kolektivní smlouvou a v neposlední řadě také s procesem kolektivního vyjednávání v podmínkách Skupiny ČEZ. Pozornost na závěr si jistě zaslouží i fakt, že společnost ČEZ, a. s., se stala jedním z prvních řídících zaměstnavatelů ve smyslu § 289 odst. 2 zákona č. 262/2006 Sb., zákoník práce, v platném znění, kde byla ustavena evropská rada zaměstnanců. Proto je i této formě zastupování zaměstnanců věnováno několik málo slov.

Abstract:

The present thesis deals with the issues of social representation of employees in Czech labor law, not only from the perspective of analysis and evaluation of the present legislation, but also from the perspective of principal development changes that have recently happened in this area. The thesis also emphasizes the principal differences between individual representatives of employees. The work is divided into several chapters as described below. After the introduction and clarification of collective labor law position within the system of labor law, I firstly defined ?collective labor law relationships?. Having defined the abovementioned term, I fluently passed to historical review of collective labor law relationships in our country. The comparison of the importance of collective labor law relationships in the past and present is subsequently provided. The next subchapter offers a comprehensive summary of legislative development of collective labor law relationships in the last few years. In new Labor Code (Act no. 262/2006 Coll.) which came into effect on the 1st of January 2007 there remained a whole range of ?force? provisions giving such competences to trade unions which in opinion of the panel of the Constitutional Court of the Czech Republic do not pertain to such an organization. The next chapter is focused on the principle of social representation in labor law relationships. Specifically, I dealt with various types of representatives of employees and their rights which are divided for better clarity into those pertaining to all representatives of employees and those exclusively disposed by trade unions. Therefore, the aim of the chapter is, inter alia, to define a position of a trade union as one of the parties in a collective bargaining representing employees. In the part dealing with elected representatives of employees, introduction of their key tasks could not be omitted. I also described their importance and position in social representation system. In conclusion of this part of my thesis, I summarized the main differences between different variants of employee representation. The third chapter is titled ?European Works Council?. As implied by the title, this part of the thesis deals with the process of establishment of this institute, firstly from the European law perspective, and then in detail according to the Czech labor law legislation. In the part devoted to the future of collective labor law relationships, special attention was given to some imperfections which, in my opinion, are present in the current legislation. Furthermore, several suggestions on labor law legislation changes are included, therefore presenting a certain contribution to the discussion about Czech collective labor law matters. The last part of my thesis (chapter five) is, as evident from the title, focused on social politics in ČEZ Group. At first, I tried to describe the position of trade unions in this company, where social conciliation is one of its priorities. Furthermore, the chapter includes description of the contents of collective agreement applied in ČEZ Group. And last but not least, I pursued the description of the issue of collective bargaining in terms of ČEZ Group. In the final part of this chapter, I could not have omitted mentioning European Works Council of ČEZ Group, as the controlling company ČEZ, a. s., has become the first Czech company to fulfill the conditions for European Works Council establishment.
