Abstract:

Diplomová práce „Jednání podnikatele v aktuální judikatuře a praxi“ má za cíl analyzovat právní úpravu jednání podnikatele s důrazem na její výklad prováděný soudy. Práce je rozdělena do několika částí. V první části jsou vymezeny obecné pojmy týkající se jednání podnikatele. Další část je zaměřena na jednotlivé způsoby jednání podnikatele – statutární orgány, prokura atd. Třetí část je věnována problematice souběhu funkcí statutárních orgánů nebo jejich členů jako zaměstnanců. Poslední část obsahuje praktické příklady, které mohou nastat při písemných právních úkonech, a naznačení jejich řešení.

Abstract:

The aim of the diploma thesis „The Action of the Enterpriser“ is to analyze the legal regulation of entrepreneurial action in combination with judicial interpretation. The thesis is divided into several parts. The first part contains definitions of general concepts concerning legal acts of entrepreneur. The second part focuses on different types of entrepreneurial conduct – authorized representatives, procuration etc. The third part describes certain aspects of the issue of concurrent offices within a company. The last part is more practically oriented and contains examples of situations occurring in written legal acts and offers possible solutions.
