Judicial power as a political actor in the institutional system of the European Union. The influence of the Court of Justice of the European Union on European public policy shaping

Abstract:

Práce zkoumá vliv Soudního dvora na formování evropských veřejných politik. V první části práce je představen koncept judicizace a to z pohledu několika vybraných autorů. Druhá část práce je věnována Soudnímu dvoru Evropské unie jako instituci v politickém systému Evropské unie. Tato část je popisuje historické okolnosti vzniku Soudního dvora, právní vymezení a jeho strukturu. Dále je zde představen tribunál. Čtvrtá kapitola se věnuje působnosti Soudního dvora, kde jsou představeny různé druhy řízení, které mohou probíhat před Soudním dvorem. Klíčovou kapitolou je pak kapitola věnovaná roli Soudního dvora v politickém systému EU a rozboru vybraných rozsudků Soudního dvora. V rámci této kapitoly nechybí akademická diskuze a reflexe činnosti ze strany politických aktérů. Cílem práce je zjistit, zda se Soudní dvůr chová jako politický aktér nebo zda naplňuje zásady soudnictví a je tedy zcela nestranným aktérem v institucionálním systému EU.

Abstract:

The master thesis examines the influence of the Court of Justcie on European public policies shaping. The first part of the thesis introduces the concept of judicialization from the perspective of several selected authors. The second part is dedicated to the Court of Justice of the European Union as an institution in the political system of the European Union. This section describes the historical circumstances of establishing the Court of Justice, the legal basis and its structure. The fourth chapter deals with the scope of the Court of Justice, where various types of proceedings may be brought before the Court of Justice. The key chapter analyze role of the Court of Justice in the EU political system, which is based on analysis of selected judgments of the Court of Justice. There is an academic discussion and reflection on the activities of political actors within this chapter. The aim of the thesis is find out whether the Court behaves as a political actor or fulfills the principles of the judiciary and is impartial actor in the institutional system of the European Union.
