The Methods for Assessing the Offers in Public Procurements

Abstract:

Tato diplomová práce je primárně zaměřena na vymezení problematiky procesu hodnocení nabídek v rámci zadávacího řízení veřejných zakázek a jeho specifických aspektů, s poukazem na možnost aplikace metody Best Value Procurement, která je příznačná zejména pro nizozemskou právní úpravu. Nejprve autor vymezuje základní pojmy práva veřejných zakázek, jejichž znalost považuje za nezbytnou pro naplnění cíle této diplomové práce. Autor se dále zabývá analýzou právní úpravy hodnocení nabídek, a to jak z hlediska historického, tak i současného, kterou následně porovnává s holandskou právní úpravou veřejných zakázek. Následně autor přibližuje základní aspekty a kritéria spojená s aplikací metody Best Value Procurement. Na základě provedené analýzy a komparace pak autor v závěru diplomové práce provádí kritické hodnocení české právní úpravy a uvádí několik úvah de lege ferenda, které považuje za vhodné v České republice provést, aby bylo možné metodu Best Value Procurement bez dalšího aplikovat.

Abstract:

This thesis is primarily focused on defining the issues of the bid evalu-ation process in public procurement procedures and its specific aspects with reference to the possibility of application of the Best Value Procurement method which is characteristic especially for the Dutch legislation. Firstly author defines the basic concepts of public procurement law which he considers necessary for the fulfillment of the aim of this thesis. The author further analyzes the legal regulation of the bid evaluation, both from historical and contemporary point of view, which he compares with Dutch public procurement law. Subsequently, the author introduces fundamental aspects and criteria associated with Best Value Procurement. On the basis of the analysis and comparison, the author at the end of thesis performs a critical assessment of the Czech legislation and provides several de lege ferenda considerations which he consideres appropriate to enact in the Czech Republic so that the Best Value Procurement method could be applied without any further processing.
