Mediation proceedings in SR and CR

Abstract:

This bachelor thesis deals with the mediation procedure as one of the alternative forms of dispute resolution in the Czech and Slovak republics. This is a relatively young institution, which is slightly extended and used by the general public. In the first part of this work is characterized by the very concept of mediation in terms of not only theoretical but also from the perspective of history, the subject of the mediation procedure and the ways to address, in which areas are the alternative uses and the actual legislation in Slovakia, but also in the Czech Republic. The second part is devoted to the subject of mediation proceedings, in particular, the mediator and his competence. The major and most important part, we can say that it is the analytical part of the work, is the process of mediation procedure and its phases, resulting in a mediation agreement. As with any legal process, as well as legal mediation has its shortcomings. The last part focuses on the comparison of the mediation procedure of judicial proceedings in Slovakia and the Czech Republic, and what are the advantages and disadvantages in both cases.

Abstract:

Bakalárska práca sa zaoberá mediačným konaním ako jednou z alternatívnych foriem riešenia sporov v Slovenskej a Českej republike. Ide o pomerne mladý inštitút, ktorý je málo rozšírený a využívaný laickou verejnosťou. V prvej časti tejto práce je charakterizovaný samotný pojem mediácie nielen z pohľadu teoretického, ale aj z pohľadu histórie, predmet mediačného konania a jeho spôsoby riešenia, v akých oblastiach sa táto alternatíva využíva a samotná právna úprava v Slovenskej, ale aj v Českej republike. Druhá časť je venovaná subjektom mediačného konania, osobitne však mediátorovi a jeho kompetenciám. Podstatnú a najdôležitejšiu časť, dá sa povedať, že ide o analytickú časť práce, tvorí samotný proces mediačného konania a jeho fázy, ktorého výsledkom je mediačná dohoda. Tak ako každý právny proces, tak aj mediačný má svoje právne nedostatky. Posledná časť je zameraná na porovnanie mediačného konania so súdnym konaním v Slovenskej a v Českej republike, a aké sú výhody a nevýhody v oboch konaniach.
