Abstract:

Práce je zaměřena na popis a hodnocení aktuálního znění živnostenského zákona s důrazem na vznik, průběh a zánik živnostenského oprávnění. Současně obsahuje snahu poukázat na problémy, které právní úprava na úseku živnostenského oprávnění přináší jednak pro podnikatelskou veřejnost a jednak pro činnost živnostenských úřadů. V úvodu je krátce nastíněn vývoj živnostenského podnikání na území České republiky s uvedením zásadních novel živnostenského zákona přijatých od 90. let dvacátého století. Přibližuji uspořádání živnostenských úřadů a jmenuji činnosti jimi vykonávané. Vymezuji živnostenské podnikání vůči podnikání dle jiných právních předpisů, jednak tím, že definuji znaky živnosti a na druhé straně tím, že uvádím činnosti vyloučené z působnosti živnostenského zákona. Zabývám se subjekty, které mohou provozovat živnost a podmínkami, které musejí pro získání oprávnění a při jeho provozování splňovat. Popisuji proces vzniku živnostenského oprávnění ohlášením živnosti a žádostí o koncesi. Uvádím rozdíly mezi podáním fyzických a právnických osob v návaznosti na to, zda se jedná o tuzemskou či zahraniční osobu. Nastiňuji povinnosti, kterými se podnikatelé musejí řídit při provozování živnosti, především pak oznamování změn souvisejících s provozováním živnosti. Kromě zrušení živnostenského oprávnění na žádost podnikatele zmiňuji i další důvody, které vedou k zániku oprávnění. V závěru práce definuji základní znaky jednotlivých druhů živností, tedy živnosti volné, živností řemeslných, vázaných a koncesovaných.

Abstract:

The work focuses on a description and evaluation of the current wording of the trading law, with emphasis on the establishment, course and expiry of trading authorisation. At the same time it contains an endeavour to identify problems which the legal arrangement in the section of trading authorisation brings, partially for the commercially active public and partially for the activity of trading offices. The introduction contains a brief outline of the development of trading enterprise within the territory of the Czech Republic, listing the fundamental amendments to the trading law passed since the 1990s. I describe the arrangement of trading offices and name the activities performed thereby. I outline trading enterprise as against enterprise according to other legal prescriptions, partially by defining the characteristics of trading and partially by presenting activities excluded from the jurisdiction of the trading law. I engage with subjects which may conduct trading and the conditions which they must meet in order to obtain authorisation, and during the operation thereof. I describe the process of the establishment of trading authorisation by declaration of trade and application for a licence. I present the differences between the submissions of natural persons and legal entities in connection to whether this represents a domestic or foreign entity. I outline the obligations by which entrepreneurs must abide in conducting trade, primarily notification of changes in connection with the operation of trade. In addition to the cancellation of trading authorisation upon request from the entrepreneur, I also mention further reasons which may lead to the expiry of authorisation.
