Bias, Independence and Impartiality of Arbitrators in International Commercial Arbitration

Abstract:

Mezinárodní rozhodčí řízení je díky rozvoji mezinárodních obchodních vztahů dlouhodobě na vzestupu. Mezinárodní rozhodčí instituce ve většině deklarují kontinuální nárůst řešených sporů. Vzhledem k celé řadě faktorů je však okruh osob a advokátních kanceláří působících v tomto právním segmentu značně uzavřený a úzký. Mohou tak vznikat konflikty zájmů mezi stranami, respektive jejich právními zástupci a rozhodci. Motivací k eliminaci těchto negativních jevů je zajištění spravedlnosti v podobě spravedlivého procesu. Idea spravedlnosti, spravedlivého procesu a také identifikace střetu zájmů se v čase proměňuje a je posuzována s ohledem na aktuální morálku nebo pozitivní právo. Práce tyto jevy analyzuje a zkoumá průsečíky mezi ideou spravedlnosti, pojdatosti, nezávislosti a nestrannosti rozhodců v mezinárodní obchodní arbitráži a odlišnosti v čase.

Abstract:

International arbitration is, due to the development of trade relations, on the rise every year. Most international arbitration institutions point out a continuous increase of disputes they have to deal with. However, due to a number of factors, the range of persons and law firms operating in this legal segment is very closed and narrow. Therefore various conflicts of interests among the parties, or their legal representatives and arbitrators, may arise. The motivation behind the efforts to eliminate these negative phenomena is to ensure justice in the form of a fair trial. The idea of justice, due process of law and the identification of conflicts of interests has been transforming in time, being viewed with regard to the current morality or positive law. The dissertation analyzes these phenomena examining intersections among the ideas of justice, bias, independence and impartiality of arbitrators in international commercial arbitration, and also differences in time.
