The United Nations Convention on the Law of the Sea: the Right of Innocent Passage

Abstract:

Tato diplomová práce se zabývá právem pokojného proplutí, a to jak v jeho historickém kontextu, tak v jeho dnešní podobě, především jako kodifikované normy v rámci Úmluvy spojených národů o mořském právu. Jejím účelem je přiblížit tento institut mořského práva a poukázat na možné nedostatky jeho současné úpravy, a to na základě výkladu jeho vývoje a rozboru několika významných událostí jako modelových případů.

Abstract:

This diploma thesis approaches the right of innocent passage within its historical context as well as its present form, above all a codified norm within the United Nations Convention on the Law of the Sea. The purpose of the paper is to describe this Law of the Sea institute and to point out potential drawbacks of its present form via the explication of its development and an analysis of several significant incidents as examples.
