The Consequences of Deprivation of Legal Capacity for People with Mental Disability

Abstract:

Ve své diplomové práci se zabývám problematikou zbavení způsobilosti k právním úkonům u osob s mentálním postižením a důsledků, které tento status danému jedinci přináší. Teoretická část vychází z odborných publikací. V jednotlivých kapitolách představuji vývoj postojů majoritní společnosti k osobám s mentálním postižením, české i mezinárodní dokumenty upravující práva osob s postižením a samotný institut zbavení způsobilosti k právním úkonům a z něj vyplývající důsledky. V praktické části pak prezentuji výsledky výzkumného šetření zaměřeného na to, jak jsou důsledky zbavení způsobilosti k právním úkonům vnímány opatrovníky, odborníky na problematiku práv osob s mentálním postižením, lidmi, kteří s osobami s postižením pracují a v neposlední řadě samotnými osobami s mentálním postižením zbavenými způsobilosti. Výsledkem práce je pak zhodnocení získaných dat dle jednotlivých sledovaných oblastí a návrh opatření pro zlepšení současné situace týkající se zásahů do způsobilosti u osob s mentálním postižením.

Abstract:

In my thesis I investigate deprivation of legal capacity at people with mental disability and the consequences arising from this deprivation. The theoretical part is based on scientific publications. In individual chapters I introduce the development of attitudes of society towards the people with mental disability, Czech and international documents dealing with the rights of persons with disability, the institute of deprivation of legal capacity and the consequences resulting from this deprivation. In the practical part I present the results of my research. The research examines how are consequences of deprivation of legal capacity perceived by guardians, experts at the rights of persons with mental disability, people who work with persons with mental disability and most importantly the people with mental disability deprived of legal capacity themselves. The outcome of the thesis is evaluation of data according to key areas and suggestions for improvements of current situation concerning intervention to legal capacity at people with mental disability.
