Selected Aspects of International Commercial Arbitration Conducted under the Rules of the Arbitration Court Attached to the Economic Chamber of the Czech Republic and the Agricultural Chamber of the Czech Republic in Comparison with Proceedings Conducted under the VIAC Arbitration Rules

Abstract:

Diplomová práce se zabývá mezinárodním rozhodčím řízením vedeným dle Řádu Rozhodčího soudu při HK ČR a AK ČR a mezinárodním rozhodčím řízením vedeným dle Rozhodčích pravidel VIAC. Cílem práce je přiblížit fungování těchto dvou rozhodčích institucí a následně u vybraných otázek identifikovat a popsat klíčové rozdíly či podobnosti mezinárodního rozhodčího řízení vedeného dle Řádu Rozhodčího soudu při HK ČR a AK ČR a mezinárodního rozhodčího řízení vedeného dle Rozhodčích pravidel VIAC. Práce se proto dále věnuje otázkám ustanovení rozhodců, vedení řízení a dokazování, jakož i otázce nákladů řízení.

Abstract:

The thesis deals with international arbitration conducted under the Rules of the Arbitration Court attached to the Economic Chamber of the Czech Republic and the Agricultural Chamber of the Czech Republic, and with international arbitration conducted under the VIAC Arbitration Rules. The aim of the thesis is to outline the functioning of these two arbitral institutions and subsequently, with respect to selected issues, to identify and describe the key differences or similarities between international arbitration conducted under the Rules of the Arbitration Court attached to the Economic Chamber of the Czech Republic and the Agricultural Chamber of the Czech Republic and international arbitration conducted under the VIAC Arbitration Rules. The thesis therefore further address the appointment of arbitrators, the conduct of the proceedings and the taking of evidence, as well as the issue of the costs of the proceedings.
