Plea bargaining as a form of criminal procedure

Abstract:

Diplomová práce se zaměřuje na institut dohody o vině a trestu jako alternativní formy trestního řízení. Teoretická část vymezuje základní pojmy vztahující se k dané problematice; jsou to zejména odklony v trestním řízení a jejich prvky, které jsou specifickým alternativním způsobem trestního řízení ve vztahu ke standardnímu projednání věci v hlavním líčení. Teoretické úvahy se explicitně orientují na jednu z forem odklonů, kterou je dohoda o vině a trestu. Tato část práce pojednává o vztahu institutu dohody o vině a trestu k základním zásadám trestního řízení, popisuje jeho historický vývoj, princip, účel a rovněž se zaobírá objasněním činnosti spojené se sjednáváním dohody o vině a trestu zejména ve vztahu ke státnímu zastupitelství, obhajobě a soudu. Materiálová část předkládá rozbor institutu dohody o vině a trestu na podkladu objektivních statistických dat a srovnává jeho využití od doby zavedení do českého trestního práva až do současné doby a diskutuje využití zkoumaného institutu při vyšetřování trestné činnosti.

Abstract:

The thesis deals with the issue of plea bargain as an alternative to the standard form of criminal proceedings. The theoretical part defines the basic concepts related to this issue, in particular diversions in criminal proceedings and their elements as a specific alternative way of criminal proceedings in relation to the standard hearing of case in the main proceedings. The theoretical considerations focus explicitly on the plea bargain as a special form of diversion. This part of the thesis discusses the relationship between the institution of plea bargain and the basic principles of criminal proceedings, describes its historical development, principles and purpose. Further on it deals with activities associated with negotiating a plea agreement, especially in relation to the public prosecutor's office, the defense and the court. The material part presents a comparative analysis of specific cases of plea bargain based on objective statistics and discusses the examined institute in criminal proceedings in the period from the introduction of plea bargaining into the Czech legal system until the present time.
