Handling of the Community Trademark as the Object of the Property Rights

Abstract:

Cílem diplomové práce na téma „Nakládání s ochrannou známkou Společenství jako s předmětem vlastnictví“ je vymezit pojem vlastnického práva, analyzovat pojem a funkci ochranné známky Společenství a popsat základní možné dispozice, které u ochranné známky Společenství připadají v úvahu, přičemž nebude opomenut také rozbor právního režimu jednotlivých dispozic. Předmětem zkoumání budou dispozice uvedené v nařízení Rady (ES) č. 207/2009, o ochranné známce Společenství. V práci představím také vybraná rozhodnutí Evropského soudu pro lidská práva a Soudního dvora Evropské unie.

Abstract:

The aim of this diploma thesis named „Handling of the Community Trademark as the Object of the Property Rights“ is to explain the meaning of the property law, to analyse the meaning and purpose of the Community trade mark and finally to describe the basic handling with the Community trade mark. Legal regime of analysed handling will not be omitted. This thesis is focused on handling with the Community trade mark laid down in the Council regulation (EC) No. 207/2009, on the Community trade mark. I also introduce selected judicial rulings of European Court of Human Rights and Court of Justice of the European Union.
