The First-Level Infringement Procedure Under New Legislation

Abstract:

Dne 1. 7. 2017 došlo k rekodifikaci v oblasti správního trestání, kdy nabyl na účinnosti zákon č. 250/2016 Sb., o odpovědnosti za přestupky a řízení o nich a zákon č. 251/2016 Sb., o některých přestupcích. Cílem práce je analyzovat novou právní úpravu se zaměřením na procesní část prvostupňového přestupkového řízení, včetně hodnocení jejího smyslu, významu, návaznosti, aplikovatelnosti a jejího dopadu. Ve své práci jsem použil metody analýzy, komparace, syntézy a analogie. V práci jsem provedl rozbor institutů před zahájením řízení, v průběhu řízení a po skončení řízení o přestupku, pro celistvé pochopení dané problematiky. Na základě užitých metod jsem vysvětlil základy prvostupňového přestupkového řízení, poukázal na problémy související s recentní právní úpravou, včetně možných řešení, aplikovatelnosti a smyslu recentní právní úpravy. Nová právní úprava poskytuje adresátům norem správního práva trestního vyšší míru právní jistoty, přehlednosti a ve které lze spatřovat velký posun v oblasti správního trestání. Nicméně, je nutno říci, že i v nové právní úpravě se setkáváme s řadou podstatných problémů, které nebyly odstraněny, a dokonce i takovými, které nová právní úprava přinesla.

Abstract:

As at 01.07.2017, the area of administrative sanctions was recodified and Act No. 250/2016 Coll., about Liability for administrative Infringements and Proceedings and Act No. 251/2016 Coll, about Some Misdemeanors, came into force. The author of the submitted thesis attempts to analyze the new legal regulation with the focus on the process part of the first-level infringement procedure, including the evaluation of its meaning, relevance, continuity, applicability and its impact. Methods such as analyzation, comparison, synthesis and analogy were applied in this diploma thesis. In order to provide a complex understanding of the issue, the analysis of the institutes of before the start of the administrative procedure, during the administrative procedure and after the closure of the administrative procedure, was performed in the thesis. Based on the above-mentioned methods, the author explained the basics of the first level infringement procedure, referred to the issues related to the current legal regulation including possible solutions of these issues, applicability and meaning of the current legal regulation. The new legal regulation provides the recipients of the administrative criminal law higher level of legal assurance and clarity which means a shift in the area of administrative sanctioning. Nevertheless, it should also be noted that the new legal regulation consists many fundamental issues which were not removed and moreover those which the new legal regulation brought.
