Involuntary Hospitalization from the Perspective of Human Rights Protection

Abstract:

Práce pojednává o institutu nedobrovolné hospitalizace z několika úhlů pohledu, s důrazem na jeho slučitelnost s otázkou lidských práv a jejich ochrany. Autor se nejprve zabývá vztahem lékaře a pacienta při běžném poskytování zdravotních služeb a právy pacientů, která jej silně formují. Dále je v práci postupně popsána teoretická podstata institutu nedobrovolné hospitalizace, jeho česká pozitivněprávní úprava, historický vývoj této právní úpravy a jednoduché srovnáním jejího pojetí s vybranými evropskými státy. Po těchto částech následuje rozbor samotné otázky souladu nedobrovolné hospitalizace s moderním pojetím základních práv a svobod, provedený především za pomocí judikatury Evropského soudu pro lidská práva a jiných relevantních orgánů. V závěru se pak autor krátce pozastavuje nad možným vývojem institutu nedobrovolné hospitalizace v budoucnosti, především v kontextu Úmluvy o právech osob s postižením.

Abstract:

The thesis deals with the institute of involuntary hospitalization from several points of view, with emphasis on its compatibility with the issue of human rights and their protection. The author first deals with the relationship between the physician and the patient within the framework of common provision of healthcare services and with patients' rights which strongly shape it. After that follows the description of the theoretical basis of the institution of involuntary hospitalization, the corresponding Czech legislative framework, historical development of this legislation and simple comparison of its conception with selected European countries. After these parts follows an analysis of the issue of the compatibility of involuntary hospitalization with the contemporary conception of fundamental rights and freedoms itself, carried out mainly using case law of the European Court of Human Rights and other relevant authorities. In the end, the author briefly deals with the possible development of the institute of involuntary hospitalization in the future, especially in the context of the Convention on the Rights of Persons with Disabilities.
