Abstract:

Tématem disertační práce jsou zásady soukromého práva z civilistického a ústavněprávního pohledu, z pohledu systematického a aplikační praxe. První kapitola (pojem soukromého práva) a druhá kapitola (pojem právních principů) představují teoretické východisko pro třetí stěžejní kapitolu této práce, kterou jsou právě zásady soukromého práva. Pro zásady soukromého práva musí platit přísný právní dualismus, neboť zásady soukromého práva jsou aplikovatelné pouze v právu soukromém. Z hlediska metod uplatňovaných pro rozlišování soukromého a veřejného práva byl učiněn závěr, že pro zkoumání právních zásad je nejvhodnější metoda právní regulace. V případě soukromého práva jsem identifikoval následující zásady soukromého právo, a to zásadu autonomie vůle, zásadu dispozitivnosti, zásadu ochrany slabší strany, zásadu rovnosti, zásadu poctivosti, zásadu dobré víry a zásadu, že jen bdělým náleží práva. Redukcí na tyto vyjmenované zásady lze dostatečně popsat pojem soukromého práva, jakož i vystihnout jeho podstatu. Základní zásadou soukromého práva je zásada autonomie vůle osob soukromého práva, osob svobodných, které si mohou právní poměry v režimu soukromého práva uspořádat podle svého svobodného uvážení.

Abstract:

The topic of the dissertation is the principles of private law, which are researched from a constitutional point of view, from a systematic point of view and from the point of view of applied practice. The first chapter (the concept of private law) and the second chapter (the concept of legal principles) represent the theoretical basis for the third main chapter of this work, which are the principles of private law. Strict legal dualism must apply to the principles of private law, as the principles of private law are applicable only in private law. In terms of the methods used to distinguish between private and public law, it was concluded that the most appropriate method for examining legal principles is the method of legal regulation. In the case of private law, I have identified the following principles of private law, namely the principle of autonomy of will, the principle of dispositivity, the principle of protection of the weaker party, the principle of equality of subjects, the principle of honesty, the principle of good faith and the principle that only the vigilance has rights. By reducing to these enumerated principles, the concept of private law can be sufficiently described as well as its essence. The basic principle of private law is the principle of autonomy of will of private law persons, free persons who can organize legal relations in the regime of private law at their own discretion.
