Abstract:

Tato diplomová práce je zaměřena na vyšetřovací experiment z pohledu teoretického i praktického. Nejdříve v úvodu jsou vymezeny pojmy, které je nezbytné si uvést a vysvětlit, stejně tak i prameny práva. V teoretické části je vymezena také kriminalistická stopa. Velkou část tvoří kapitola zabývající se kriminalisticko- taktickými metodami. Stěžejní v teoretické části je vymezení vyšetřovacího experimentu. Jeho cíle, typy, formy i účastníci vyšetřovacího experimentu. Dále je popsán průběh vyšetřovacího experimentu, od jeho přípravy až po jeho zhodnocení a dokumentaci. V praktické části je uveden jeden případ z praxe, který je podrobněji popsán a rozebrán. Cílem této diplomové práce je vymezit subjektivní vnímání nějaké situace a zjistit jak důležité může být využití vyšetřovacího experimentu v praxi. Pro naplnění cíle této diplomové práce využiji metodu popisu. V praktické části bude využita zejména výzkumná metoda experimentu.

Abstract:

This thesis is focused on the investigative experiment from the theoretical and practical point of view. First of all, the terms that need to be stated and explained, as well as the sources of law, are defined in the introduction. In the theoretical part is also a criminalistic trace. A large part of thesis is the chapter deals with the criminalistic-tactical methods. The crucial part of the theoretical part is the definition of the investigative experiment. Its aims, types, forms and participants in the investigative experiment. The course of the investigative experiment is also described, from its preparation to its evaluation and documentation. In the practical part there is one case from practice which is described in more detail and discussed. The aim of this thesis is to define the subjective perception of a situation and to find out how important the use of an investigative experiment can be in practice. To fulfill the aim of this thesis I use the description method. In the practical part, the research method of the experiment will be used.
