Specifics of Interrogation of Youth and Children

Abstract:

Má bakalářská práce pojednává o specifikách výslechu mladistvých a dětí. V první kapitole se nejprve věnuji výslechu v obecné rovině, jak z pohledu kriminalistiky, trestního práva, tak i psychologie. Dále se podrobně zaměřuji na samotný výslech dětí a mladistvých, jak na zvláštnosti a odlišnosti oproti klasickému výslechu, tak na postup. Dále na důležitosti pokládání otázek a důvěryhodnost výpovědi. S dětmi a mladistvými úzce souvisí také viktimologie, a to hlavně sekundární viktimizace, proto jsem ji v mé bakalářce věnovala samostatnou kapitolu. Většina lidí si mladistvé a děti představuje spíš v roli oběti, ale ne vždy tomu tak je, proto se v samostatné kapitole věnuji delikvenci mladistvých a dětí a jejich trestní odpovědnosti a možnostem nápravy. K výslechu mladistvých a dětí také neodmyslitelně patří i speciální výslechová místnost, které se věnuji v samostatné kapitole, kde vysvětluji její důvod vzniku, vzhled, kdo kromě dítěte v ní může být vyslýchán a mimo jiné i demonstračním pomůckám v ní využívaných. Cílem této bakalářské práce je dostat tuto problematiku do podvědomá širší veřejnosti, aby pochopili, jak se například ke svým dětem chovat, když se stanou obětí trestného činu a jak se postavit k samotnému výslechu, a nakonec pochopení důvodů, proč je s dětmi a mladistvými jednáno jinak než s dospělou osobou.

Abstract:

My bachelor thesis is about the specifics of interrogating minors and children. In the first chapter, I first focus on interrogation in general, from the perspective of criminology, criminal law, and psychology. I then delve into the specifics of interrogating children and minors, including the differences and peculiarities compared to classic interrogation techniques and the proper procedures to follow. I also explore the importance of asking questions and the credibility of testimony. The subject of victimology, especially secondary victimization, is closely related to children and minors, so I dedicated a separate chapter to it in my thesis. Most people tend to think of minors and children as victims, but that is not always the case. Therefore, in another separate chapter, I discuss the criminal responsibility of minors and children who engage in delinquent behavior and their potential for rehabilitation. Interrogating minors and children also requires the use of a special interrogation room, which I cover in a separate chapter, explaining its purpose, appearance, who can be interrogated besides the child, and the demonstration aids used in the room. The goal of this thesis is to raise awareness of this issue among the general public, helping them understand how to behave towards their children when they become victims of a crime, how to approach the interrogation process, and ultimately understand why minors and children are treated differently from adults.
