Abstract:

Diplomová práce se zabývá tématem "Zánik mandátu člena zastupitelstva územního samosprávného celku". Cílem práce je poskytnout ucelený náhled na tuto problematiku. V prvé řadě se zabývá vymezením mandátu člena zastupitelstva. Pojednává o vzniku mandátu. Rovněž popisuje samotnou funkci a postavení člena zastupitelstva. V práci jsou dále konkrétně rozebrány jednotlivé způsoby a situace, za kterých dochází k zániku mandátu. To vše je rozebíráno v kontextu s aktuální právní úpravou a judikaturou soudů. Zmíněny jsou také možné důsledky zániku mandátu. Práce se dále zaměřuje na možnost soudní ochrany člena zastupitelstva v souvislosti se zánikem jeho mandátu. V práci není opomenuto ani vymezení pojmů, souvisejících s touto problematikou, tj. neslučitelnost funkcí, nástupnictví a odchodné člena zastupitelstva.

Abstract:

The thesis deals with the subject of "The Termination of Mandate of Local Government Council Member". The aim of the thesis is to provide a comprehensive view of this issue. Primarily, thesis deals with the definition of the mandate of a member of a municipal council. It deals with the establishment of the mandate. It also describes the function and position of a member of a municipal council. Thesis also specifically analyzes different ways of termination of the mandate of a member of a municipal council, according to the current legal regulation and case-law. The possible consequences of the termination of the mandate are also mentioned. Thesis also focuses on the possibility of judicial protection of a member of a municipal council in connection with the termination of the mandate. Moreover, the thesis defines the terms related to this issue, i.e. the incompatibility of functions, the succession and the exit payment of a member of a municipal council.
