Mediation as an alternative resolution

Abstract:

Bakalářská práce se věnuje vývoji mediace, rozsahu její úpravy a jejím jednotlivým fázím. Cílem textu je mediaci podrobně rozebrat od její historie, legislativního procesu a schvalování zákona o mediaci na území České republiky, až po reflektování současného vývoje mediace. Dále se práce zabývá rozsahem úpravy mediace, jejími jednotlivými fázemi v praxi, co se týče přípravy, zahájení, získávání informací ohledně mediace a celkového průběhu mediačního procesu. Řeší také roli, do které je postaven samotný mediátor, konkrétně co se týče zásad chování, které je mediátor povinen dodržovat, dále jeho potřebné vzdělání k této činnosti, nástroje, které používá v mediačním řízení a jeho povinnost mlčenlivosti. V závěru práce jsou obsaženy autorčiny úvahy de lege ferenda.

Abstract:

This dissertation is dedicated to the evolution of the mediation, the extent of its adjustments and its individual stages. The goal for this dissertation is to analyze the mediation; starting from history, legislation process, approval of the law regarding the mediation on the territory of Czech Republic, until the recent reflection concerning the current development of mediation. Furthermore, this dissertation is going to focus on the extensive mediation adjustments, individual mediation’s stages in practice, in terms of preparation, initiation, obtaining information about mediation and the overall course of the mediation process. Also solves the role in which the mediator is placed in, specifically the principles of conduct which is mediator is obliged to observe, as well as his necessary education for this activity, the tools he uses in meditation proceedings and his duty of confidentiality. Autor’s considerations and thoughts in regards to the de lege ferernda are included at the end of this dissertation.
