Assistance to victims of crime

Abstract:

Diplomová práce se zabývá poskytováním pomoci obětem trestných činů. Zaměřuje se na subjekty, poskytující odbornou pomoc a také na práva, která jsou obětem deklarována podle zákona 45/2013 Sb., o obětech trestných činů. Mým cílem při psaní této práce bylo předložit co nejvíce informací týkajících se pomoci obětem bezprostředně po spáchaném trestném činu. Vstupní kapitoly jsou věnovány vymezení základních pojmů oběť, poškozený a viktimologie. Pro účely této práce se převážně věnuji pojmu oběť. Třetí kapitola odkazuje na činnost konkrétních subjektům zapsaných v Registru poskytovatelů pomoci obětem trestných činů a uvádí formy pomoci a poradenství, které mohou oběti od těchto institucí očekávat. Následující kapitola řeší, jak mohou uplatňovat své právo podle zákona oběti některých deliktů, konkrétně oběti dopravních nehod a oběti domácího násilí. Práce s obětí vyžaduje citlivé a ohleduplné zacházení, přesto existují oběti, kterým tato zvláštní péče náleží dvojnásob. Jsou jimi zvlášť zranitelné oběti, jimž jsou přisuzována určitá speciální práva. Těmito oběťmi se zabývá kapitola pátá. Oběť trestného činu vystupuje také v rámci trestního řízení. Proto poslední část mé práce věnuji základním právům obětí a poškozených, která jim náleží podle zákona o obětech trestných činů, a které mají za cíl předejít opakované viktimizaci.

Abstract:

The thesis deals with the provision of assistance to victims of crime. It focuses on some entities, providing the proffesional assistance and also on the rights of victims which are declared under the Act 45/2013 Coll., about victims of crime. The aim of the thesis is to submit as much information as possible relating to assistance for the victims immediately after commiting the criminal offences. The introductory chapters are dedicated to defining the basic concepts of victim, injured person and victimology. For the purpose of this thesis I mainly intend on the concept of the victim. The third chapter refers to the activity of specific entities registered in the Registry of victim assistance providers and shows some forms of assistance and consultation which can be expected from these institutions. The following chapter tries to solve how the victims of some criminal offences can assert their right under the law, specifically the victims of road accidents and the victims of domestic violence. The work with the victim requires sensitive and considerate treatment, nevertheless there are some victims, to whom this care belongs doubly. They are particularly vulnerable victims with attribution of certain special rights. These victims are addressed in Chapter five. The victim of criminal offence also performs in the criminal proceedings. Therefore, the last part of my thesis is dedicated to fundamental rights of the victims and injured people, which pertains to them according to the law of victims of crime, and which have the aim to prevent from the repeated victimisation.
