Konání a opomenutí z hlediska nového trestního zákoníku

The Comission and Omission from the New Criminal Code Point of View
Abstract:
Téma mojí práce se zabývá jednáním pachatele, které může mít dvojí podobu, a to konání nebo opomenutí. Správné posouzení, kterým z těchto dvou způsobů jednání byl trestný čin spáchán, je v některých případech klíčové pro správné posouzení právní kvalifikace. Správná právní kvalifikace pak zaručuje, že pachatel bude spravedlivě potrestán za čin, který spáchal.
Abstract:
The theme of my work deals with the conduct of the offender, which may be twofold, and that act or omission. Proper assessment of which of these two ways of doing things was the crime committed, in some cases is crucial for a correct assessment of the legal classification. The correct classification of the legal guarantees that the offender will be justly punished for an act he committed.
