Historical and legal aspects of the abolition of the monarchy and the provisions of the republic of France in 1792

Abstract:

The intention of work is to show, describe and analyze the profound crisis in detail feudal regime in France at the turn of the 18th century, in the period before the revolutionary wave in the years 1789 – 1794, which led to the collapse of the old feudal regime, the abolition of the monarchy and establishment a new form of government – the Republic, which held power nascent social class – bourgeoisie. In the center of attention is to explain the historical significance of bourgeois revolution, the response in the world, showing its impact, especially in the development of law and particulary to eliminate the feudal civil-legal relations, in the particular the disposal of feudal property, the creation of individual private ownership of production resources, the introduction of equality and legal capacity of free people.

Abstract:

Zámerom práce je zobraziť, charakterizovať a podrobne rozobrať hlbokú krízu feudálneho režimu vo Francúzsku na sklonku 18. storočia, v období pred revolučnou vlnou v rokoch 1789-1794, ktorá mala za následok pád starého feudálneho režimu, zrušenie monarchie a nastolenie novej formy vlády - republiky, v ktorej moc uchopila novovznikajúca spoločenská trieda - buržoázia. V centre pozornosti je vysvetlenie historického významu buržoáznej revolúcie, jej ohlasu vo svete s poukázaním na jej dôsledky najmä v oblasti vývoja práva a to jednak na odstránenie feudálnych občiansko-právnych vzťahov, najmä likvidáciu feudálneho vlastníctva, zakotvenie buržoázneho vlastníctva, vytvorenie individuálneho súkromného vlastníctva výrobných prostriedkov, zavedenie rovnosti a právnej spôsobilosti slobodných ľudí.
