Traffic regulation by local self-governments

Abstract:

Rigorózní práce se věnuje problematice lokální regulace pozemní dopravy, kterou vykonávají územně samosprávné celky. Lokální regulací pozemní dopravy se přitom pro účely této práce rozumí taková činnost obcí, která směřuje k řízení dopravní situace na konkrétních úsecích pozemních komunikací a ostatních (neveřejných) cest. Práce se zabývá jak vrchnostenskou tak nevrchnostenskou činností obcí v této oblasti, včetně specifiky ochrany subjektivních práv osob jí dotčených. Po úvodu následuje kapitola věnující se významu a důsledkům pozemní dopravy na společnost, zejména v území obcí, s ohledem na jejich zájmy a zájmy jejich občanů. Dále se tato kapitola zaměřuje na pojem a obsahové vymezení veřejné správy na úseku lokální regulace pozemní dopravy. Následující kapitoly tvoří stěžejní část práce. Jsou věnovány jednak vrchnostenské a nevrchnostenské lokální regulaci pozemní dopravy obcí, a na ni navazujícím specifikům prostředků ochrany subjektivních práv zasažených danou regulací. V práci jsou průběžně řazeny komparativní poznámky z Velké Británie, které mohou být v mnohém pro právní úpravu České republiky inspirativní.

Abstract:

This doctoral thesis deals with the issue of local regulation of surface transportation carried out by local self-government. For the purpose of this thesis the term local regulation of surface transportation will be used to denote the activities of the municipalities which aim to manage the traffic situation on specific sections of public and private roads. The thesis deals with both the authoritative and non-authoritative municipal activities in the field of surface transportation, including the specifics of the protection of rights of persons affected by those. The introduction is followed by a chapter presenting the importance and consequences that the surface transportation has on a (municipal) society with regards to the interests of given municipality and its citizens. This chapter also focuses on the concept and definition of public administration in the field of local regulation of surface transportation. The following chapters form the most important part of this thesis. They deal with the authoritative and non-authoritative local government regulation of surface transportation and with the means of protection of individual rights affected by such regulation. Throughout the thesis, comparative notes from Great Britain are offered. These could be inspiratory for the legislation of the Czech Republic in many ways.
