Comparison of the Discrimination on the Labour Market Reflection in CZ/EU Law

Abstract:

Diplomová práce popisuje teoretická východiska diskriminace z ekonomického a právního pohledu, s důrazem na porovnání právní úpravy diskriminace na trhu práce na národní a evropské úrovni. Analyzuje konkrétní příklady vybraných diskriminačních soudních sporů a soudních rozhodnutí. Při porovnání právních úprav v ČR a EU jsou patrné některé rozdíly: - Český antidiskriminační zákon zakazuje diskriminaci na základě kteréhokoliv diskriminačního důvodu ve všech oblastech života uvedených v § 1 AntiDZ, zatímco směrnice EU poskytují ochranu selektivně. Obecně je zakázána diskriminace v pracovněprávní oblasti, v oblasti přístupu ke zboží a službám je to z důvodu etnického původu, pohlaví a rasy, v dalších oblastech jen z důvodu etnického původu a rasy. - V rámci Evropské unie jsou soudní případy založeny na systému předchozích rozhodnutí, kdy se v podobných případech rozhoduje obdobně (i když ani toto pravidlo neplatí vždy, což způsobuje nejistotu ve výkladu), zatímco v České republice se tento přístup příliš nepoužívá a vychází se striktně z aplikace právních norem. - V Evropské unii se při posuzování pracovní pozice a její náplně zohledňuje objektivní náhled ve smyslu pozice, zatímco v České republice i právní normy více zohledňují spíše ekonomický pohled, tedy obsah pracovní pozice ve smyslu pracovního výkonu. Právo by primárně mělo sloužit jako spravedlivé potvrzení pravidel, která lidé přirozeně respektují. Ovšem tato pravidla není možno aplikovat bez návaznosti na ekonomické tržní principy a ekonomické chování subjektů na trhu.

Abstract:

The thesis describes the theoretical basis of discrimination from the economic and legal point of view, with an emphasis on the comparison of the legal regulation of discrimination on the labor market at national and European level. It analyzes concrete examples of selec-ted discriminatory litigation and court decisions. There are several differences when comparing the legal regulations in the Czech Republic and the EU: - The Czech Anti-Discrimination Act prohibits discrimination based on any discriminatory reason in all areas of life described in paragraph 1 of this Act, while EU directives provide selective protection. In general, discrimination in the labor law is prohibited, in terms of access to goods and services due to ethnic origin, gender and race, in other areas only because of ethnic origin and race. - In the frame of European Union, court cases are based on a system of previous decisions where similar cases are decided similarly (although this rule does not always apply, which causes uncertainty in the legal interpretation), whereas in the Czech Republic this approach is not used too much and it is based strictly on the application of legal acts. - In the European Union, when considering the job position and its content, an objective view of the position is taken into account, while in the Czech Republic, the legal acts take more into account the economic view, which means the job position in the terms of work performance. Law should primarily serve as a fair endorsement of the rules that people naturally respect. However, these rules can not be applied without reference to economic market principles and economic behavior of market participants.
