Abstract:

Bakalářská práce se soustředí na problematiku jedné z nejdůležitějších okolností vylučujících protiprávnost - nutnou obranu, a to nutnou obranu z pohledu trestního práva. Téma je rozebráno především z teoretického hlediska pomocí metod výkladu, analýzy a srovnání. Pozornost je věnována nejdůležitějším pojmům, historickému vývoji a zejména pak jednotlivým podmínkám nutné obrany. Dále se práce zabývá vymezením nutné obrany vůči krajní nouzi, jejich shodnými a rozdílnými znaky. Značnou část práce pak tvoří zákonné určení mezí nutné obrany a vybočení (exces) z mezí nutné obrany. Nedílnou součástí práce je rovněž judikatura vztahující se k případům vybočení z mezí nutné obrany, jakož i nesplnění podmínek nutné obrany. Cílem je řešení otázky, zda je nutné vymezit podmínky a meze nutné obrany v zákoně a jakým způsobem.

Abstract:

My bachelor's thesis focuses on the issue called a necessary defense from the point of view of criminal law, which is one of the most important circumstances that exclude illegitimacy. Primarily, I looked at the topic mostly theoretically, using the methods as an explanation, analysis and comparison. I focused on the most important terminology, on its historical development and mainly on the individual circumstances of the necessary defense. Further then, my thesis concerns with a definition of a necessary defense in relation to an extreme emergency, its identical and dissimilar characteristics. A significant section of my thesis is about a definition of a necessary self defense or it's excess from a legal point of view. The inseparable part is also judicature that refers to the cases away from the necessary defense, as well as the cases of not meeting the requirements for a necessary defense. My aim is resolving important questions while defining any conditions and limits of a legal defense and in which ways.
