Abstract:

Exekuce v našem právním řádu, která je tématem práce, je zahrnuta jak do občanského soudního řádu, tak do zákona o soudních exekutorech a exekuční činnosti (exekuční řád) a do správního řádu. Účelem exekučního řízení je dosáhnout uspokojení konkrétního právního nároku věřitele přiznaného kvalifikovaným způsobem bez ohledu na ochotu dlužníka poskytnout takto přiznané plnění. Práce proto vymezuje nejen pojem exekuce, ale i pojem výkon rozhodnutí, srovnává tyto dva postupy a podrobně informuje o veškerých úkonech, které může činit jak soudní exekutor v exekučním řízení tak soudce ve výkonu rozhodnutí. Část práce je věnována novele exekučního řádu s platností od 1.1. 2013, která s sebou přinesla mnoho změn. Z praktického hlediska je v práci obsažen nástin jednání o návrhu na zastavení výkonu rozhodnutí, které probíhalo u exekučního soudu, dále také nástin dražebního jednání. V závěru práce je uvedena kapitola týkající se ukončení výkonu rozhodnutí. Cílem práce je srovnání soudního výkonu rozhodnutí a exekuce dle exekučního řádu.

Abstract:

The distraint of debtor in Czech law, which is the main topic of the thesis, is contained in both the Civil Procedure Rules and the Distraint Act (exekuční řád), as well as in the Administrative Procedure Act (správní řád). The objective of the distrain process is to satisfy legitimate claims of the creditor with no regards to the debtor’s willingness to cover such claims. The thesis not only defines the terms distraint and enforcement of judgement but it also compares them and informs thoroughly about all actions that may be carried out by both the distrainer and the judge. One part of the thesis deals with the new amendment of the aforementioned law that came into power on the January 1st, 2013 and which changed a lot in the system. The next part offers practical examples of the negitotiation to terminate a distraint which has been confirmed by the Distraint Court, and furthermore an auction is illustrated as well. The final part of the thesis describes the ways of terminating the enforcements of judgement. The task of the thesis is to compare the distraint according to the Distraint Act with the judicial enforcement.
