Abstract:

Řízení v rodinněprávních věcech je výrazně ovlivněno přítomností nebo absencí toho aspektu hmotněprávní úpravy rodinněprávní vztahů, který umožňuje ingerenci státu do těchto soukromoprávních vztahů, v důsledku čehož není právní vztah ponechán pouze na vůli jeho subjektů. Procesněprávní instituty představující kritéria, která odlišují sporné a nesporném řízení, resp. odlišné způsoby jejich projevu v řízení, vytvářejí rámec vykládané materie. Přestože se nosné úvahy týkají zjišťování skutkového stavu věci, tedy zejména základních procesních povinností účastníků – povinnosti tvrzení a důkazní povinnosti – včetně jejich korelátů v podobě břemen, nejsou opomenuty ostatní procesněprávní instituty, přičemž je zachována zákonná sekvence jejich pozitivně právního zakotvení: pravomoc a příslušnost soudu; účastenství v řízení; zahájení řízení a v jeho rámci možnost uplatnění zásady oficiality; průběh řízení a uplatnění zásady dispoziční a zásady oficiality; odlišný způsob jak soud dospívá ke skutkovému stavu věci, tedy uplatnění zásady projednací a zásady vyšetřovací; náhrada nákladů řízení; povaha a účinky meritorních rozhodnutí a konečně uplatnění rozdílných systémů apelačního principu při revizi skutkového základu věci odvolacím soudem, systému úplné a neúplné apelace.

Abstract:

Proceedings in family law matters is significantly influenced by the presence or absence of the aspect of family law, which allows state to interfere to these private legal relationships and as a result of that they are not left solely to the will of their subjects. The procedural law institutes representing criteria distinguishing the contentious proceedings and non-contentious proceedings, respectively different manners of their manifestation in proceedings, are creating framework in which is being the matter interpreted. Although the principal considerations are concerning the examination of the facts of the case, therefore basic procedural obligations of the participants – to claim the facts and to prove them in evidence – including their correlates in the form of burden, the other procedural law institutes are not omitted and their legal sequence is maintained: competence of the court and jurisdiction; participation in the proceedings; commencement of the proceedings and the possibility to apply the principle of official duty; course of the proceedings and the application of the disposition principle and the principle of official duty; different manner in which the court reaches the facts of the case, i.e. the application of the principle of hearing and the principle of investigation; compensation for the costs of proceedings; nature and effects of judgments on the merits, and finally the application of different systems of the appeal principle in revision of the facts of the case by the court of appeal, the system of complete and incomplete appeal.
