Legality of Air Strikes Against Non-State Actors: Situation in Syria

Abstract:

Tato diplomová práce se zaměřuje na problematiku sebeobrany proti nestátním aktérům v kontextu turecké intervence v severní Sýrii. Jejím cílem je zhodnotit legalitu čtyř vybraných tureckých vojenských operací z hlediska ius ad bellum. Systematicky je práce členěna na dvě části. V prvé se autor vyjadřuje k obecným otázkám extrateritoriálního užití síly, včetně konceptů, které nejsou jednotně přijímány. Pozornost je zejména zaměřena na obyčejové i smluvní aspekty práva sebeobrany. Ve druhé části je pojednáno o konkrétních příkladech užití síly v rámci ozbrojeného konfliktu.

Abstract:

This diploma thesis deals with the issue of self-defense against non-state actors in the context of Turkish intervention into northern Syria. The aim is to evaluate the legality of four selected Turkish military operations from the perspective of ius ad bellum. Systematically, the thesis is divided into two parts. The first concerns with general matters of extraterritorial use of force, including concepts that are not unequivo-cally accepted. The customary and contractual aspects of self-defense are brought into special focus. The second part deals with specific examples of use of force in an armed conflict.
