Regulation and taxation of prostitution in the Czech republic

Abstract:

Předmětem této bakalářské práce je návrh možnosti regulace v České republice, včetně možnosti zdanění příjmů z provozování této činnosti. Podkladem tohoto návrhu je definování a analýza přístupů, které může stát k prostituci zaujmout a nalezení jejich předností a nedostatků. Práce obsahuje též kritickou analýzu stávající právní úpravy prostituce v České republice a hodnotí návrhy zákona o regulaci prostituce, které byly v posledních letech předloženy Parlamentu České republiky. Vzhledem k tomu, že všechny dříve vytvořené návrhy zákona byly neúspěšné, je stále otevřen prostor pro diskuze a průzkum problematiky tak, aby byla stanovena jasná pravidla a přístup státu k tomuto fenoménu. Jelikož je celá problematika natolik rozsáhlá a komplikovaná, práce nenabízí žádná jednoduchá a rychlá řešení, představuje však řadu doporučení a upozorňuje, čeho je potřeba se při formulování právní úpravy prostituce vyvarovat, a to zejména s ohledem na lidská práva, bezpečnost a zmírnění negativních jevů souvisejících s prostitucí.

Abstract:

The subject of this bachelor thesis is the proposal of the option of regulation in the Czech Republic, including the option of taxation of incomes from prostitution. The basis of the proposal is the definition and analysis the approaches that can be taken to prostitution and definition their advantages and disadvantages. The bachelor also contains a critical analysis of the current legislation of prostitution in the Czech Republic and evaluates the bills of regulation of prostitution, which have been submitted to the Parliament of the Czech Republic in recent years. Whereas previously created bills were unsuccessful, there is still space for discussion and exploration of the issue to establish clear rules and the state's approach to the prostitution. Because the whole issue is so extensive and complicated, the bachelor does not offer any simple and quick solutions, but it presents a number of recommendations and points of what needs to be avoided in the process of formulating the legislation of prostitution, especially with regard to human rights, security and mitigation of negative phenomena with prostitution.
