Constitutional Conformity of the Interventions to Inviolability of the Home

Abstract:

Diplomová práce Ústavní souladnost zásahů do nedotknutelnosti obydlí se zabývá hodnocením zásahů do nedotknutelnosti obydlí přípustných podle českého práva. V první části práce je uveden nezbytný teoretický rámec problematiky základních lidských práv a zásahů do nich. Druhá část práce se již věnuje konkrétním případům omezení práva na nedotknutelnost obydlí v českém právním řádu a hodnocení jejich ústavní souladnosti, případně podmínek, za kterých mohou být tyto zásahy klasifikovány jako legitimní. Závěrem se práce zabývá i možnými návrhy de lege ferenda.

Abstract:

The thesis named Constitutional Conformity of the Interventions to Inviolability of the Home focuses on the evaluation of such interventions to inviolability of home according to the Czech law. The first part of the thesis contains necessary theoretical framework relating to the topic of human rights and interventions to these rights. The second part is devoted to particular cases of limitation on inviolability of the home in Czech law and evaluation of their constitutional conformity, alternatively also the conditions under which these interventions can be described as lawful. Finally the thesis concentrates on potential suggestions de lege ferenda.
