Regulatory reporting in the context of the Czech capital market

Abstract:

Předmětem diplomové práce „Regulatorní reporting v kontextu kapitálového trhu ČR“ je analýza informačních povinností vůči dohledovým orgánům v oblasti kapitálového trhu ČR se zvláštním zaměřením na obchodníky s cennými papíry, investiční společnosti a investiční fondy. Základním cílem práce je potom potvrzení nebo vyvrácení hypotézy, že na dohlížené subjekty podnikající na kapitálovém trhu je kladena nepřiměřená zátěž spočívající nejen v příliš časté frekvenci zasílání dat, ale i rozsahu informačních povinností. První část práce stručně popisuje historické souvislosti k implementaci evropského systému dohledu nad kapitálovým trhem, vymezuje legislativní základnu regulatorního reportingu v ČR a představuje cíle výkaznictví. Druhá část práce se zabývá vymezením kapitálového trhu a jednotlivých poskytovatelů finančních služeb. Třetí část pojednává o konkrétním obsahu některých výkazů. Na teoretickou část navazuje praktická aplikace poznatků na vybraného obchodníka s cennými papíry. Výstupem této části práce je posouzení souladu tohoto subjektu se všemi legislativními požadavky v oblasti dohledového výkaznictví a nákladová analýza výkaznictví.

Abstract:

The subject of the submitted thesis "Regulatory reporting in the context of the Czech capital market" is an analysis of reporting requirements to authorities supervising the Czech capital market with a special focus on securities dealers, investment companies and investment funds. The basic goal of the work is to confirm the hypothesis that the supervised entities are placed under a disproportionate burden consisting of an excessive frequency of the data submission and a vast scope of information obligations or to prove this hypothesis wrong. The first part briefly describes the historical context of implementation of the European system of supervision and the regulatory framework of the regulatory reporting in the Czech Republic. The second part characterises the nature of capital market and defines which subjects are classified as providers of financial services. The goal of the third part is to introduce the content of particular reports. The theoretical part is then followed by a practical application of the acquired knowledge on a particular securities dealer. The output of this part of the thesis is an assessment of the compliance with regulatory framework regarding this problematic and a regulatory reporting cost analysis.
