Arab Spring and its Legal Effects on the Internal and External Borders of the Schengen

Abstract:

Práce si klade za cíl postihnout právní důsledky, které mělo Arabské jaro na vnitřní a vnější hranice Schengenu. Za tímto účelem tvoří konstrukční prvky práce tři spolu zdánlivě nesouvisející události, jimiž je Arabské jaro, italsko-francouzský politický konflikt z roku 2011 a reforma Schengenského hraničního kodexu provedená v roce 2013. Práce nabízí osvětlení prvních dvou událostí a jejich vzájemné propojení za účelem komplexního pochopení třetí z nich, která je jejich přímým důsledkem a těžištěm celé práce. Zaměřuje se na teoretický rozbor dvou novel přijatých v rámci revize Schengenského hraničního kodexu a poskytuje jejich kritické zhodnocení. Analýza reformy v teoretické rovině je následně doplněna o poznatky z aplikace reformy Schengenu v praxi, ve světle eskalace migrační krize v roce 2015 a krize na řecko-tureckých hranicích. Práce tak poskytuje ucelený pohled na všechny fáze vývoje reformy Schengenu a představuje pomocný nástroj k její zdárné interpretaci.

Abstract:

This work aims at capturing legal consequences of the Arab Spring on the internal and external borders of the Schengen area. For that purpose, three seemingly independent events constitute the structural elements of this work – namely the Arab Spring, the political dispute between France and Italy in 2011 and the reform of the Schengen Borders Code, implemented in 2013. The work offers clarification of the first two events and their linking in order to arrive at a comprehensive understanding of the third one, which represents their direct result and which is the main focus of this work. It concentrates on a theoretical analysis of two amendments adopted as a result of the Schengen Borders Code revision and provides their critical evaluation. The analysis of the reform in theory is subsequently supported by the evidence gained from application of the Schengen reform in practice, in light of the escalation of the migration crisis in 2015 and of the crisis at the Greek-Turkish border. In this way, the work provides helpful instrument for its successful interpretation.
