Gross Negligence of Payment Service Users as a Limit of Liability of Payment Service Providers for Unauthorised Transactions

Abstract:

Diplomová práce se zabývá problematikou hrubé nedbalosti plátce v kontextu nápravy neautorizovaných platebních transakcí podle § 182 odst. 1 písm. b) zákona č. 370/2017 Sb., o platebním styku. Analyzuje rozhodovací praxi finančního arbitra a soudů, přičemž identifikuje klíčová kritéria posuzování hrubě nedbalého jednání plátce. Práce dále rozebírá připravovanou evropskou legislativu (PSD3 a PSR), která má zvýšit ochranu spotřebitelů proti sofistikovaným podvodům, stejně jako nároky na informovanost a opatrnost plátců a rozšířit odpovědnost poskytovatelů platebních služeb.

Abstract:

The diploma thesis deals with the issue of gross negligence on the part of the payer in the context of compensation for unauthorised payment transactions pursuant to sec. 182 para. 1 letter b) of the Payment Services Act. It analyses the case law of the financial arbitrator and courts and identifies key criteria for assessing gross negligence on the part of the payer. The thesis also discusses upcoming European legislation (PSD3 and PSR) that should increase consumer protection against sophisticated fraud, as well as the requirements for payers to be informed and cautious and extend the liability of payment service providers.
