Divided Co-ownership

Abstract:

Spoluvlastnické právo definujeme jako vlastnické právo několika subjektů, jimž na společně vlastněné věci náleží ideální podíl, který má podobu zlomku. Důležité je, že podíl je ideální – nelze jej z věci přesně oddělit. Z hlediska převodů spoluvlastnických podílů je nezbytnou podmínkou nabídka předkupního práva ostatním spoluvlastníkům v případě, kdy se nejedná o převod na osobu blízkou. V případě nepředložení této nabídky by hrozila neplatnost právního úkonu převodu. V případě rozhodování spoluvlastníků o hospodaření se společnou věcí je nezbytné rozhodnutí nadpoloviční většiny, přestože i menšinový spoluvlastník, anebo spoluvlastník, který byl přehlasován, má právo domáhat se ochrany svých práv u soudu. Spoluvlastnictví zaniká rozhodnutím soudu na základě návrhu spoluvlastníka nebo uzavřením dohody spoluvlastníků o vypořádání spoluvlastnictví. V neposlední řadě se musíme zmínit i o společném jmění manželů, kdy mluvíme o bezpodílovém spoluvlastnictví.

Abstract:

The joint ownership right can be defined as a right possessed by several legal subjects which all own an equal share of the property and their share is illustrated by a fraction. There is an improtant fact about the joint ownership – each of the owners possess an equal share of the property and so it cannot be devided accurately. As far as the case of assigning joint ownership rights to other persons is concerned, offering a priority purchase right has to be offered other joint owners first, in that case when a purchaser is not a person with a close ralation to the owner`s family. If this offer would not be submitted, the process of assigning could be declared invalid. In dealing with a property and taking decisions, working majority is requiered. On the other hand, even if a minor joint owner or co-owner has been outvoted, they can claim their right in a judicious way. The right of joint ownership can be cancelled by a decision of the court on joint owner`s proposal or by a settlement agreement signed by all joint onwers. Last, but not least, let`s mention a case of joint ownership of two married people as well – in this case, both of them are co-owners of the shared property.
