Abstract:

Rostoucí zájem o digitální měny emitované centrálními bankami (CBDC) a jejich potenciální roli ve finančním systému vyvolal potřebu komplexního zkoumání jejich právních aspektů. Tato práce se zaměřuje na právní důsledky implementace CBDC a jejich využitelnost jako forma zákonného platidla v České republice. Práce začíná teoretickým přehledem konceptu CBDC a jeho srovnáním s jinými formami peněz. Druhá část práce analyzuje implementaci CBDC ve světě a porovnává přístupy různých zemí k právním regulacím. Závěrečná část práce se zaměřuje na aplikovatelnost CBDC v České republice a hodnotí možné právní důsledky jejich zavedení. Práce komparativní metodou posuzuje vhodnost a podmínky nutné k tomu, aby se CBDC staly zákonným platidlem v České republice, včetně hodnocení důsledků takového kroku, zejména z právního hlediska. Cílem této práce je poskytnout komplexní pohled na právní aspekty CBDC a jejich potenciální roli jako formy zákonného platidla v České republice.

Abstract:

The increasing interest in central bank issued digital currencies (CBDC) and their potential role in the financial system has spurred a need for a comprehensive examination of their legal aspects. This thesis focuses on the legal implications of CBDC implementation and their suitability as a form of legal tender in the Czech Republic. The paper begins with a theoretical overview of the concept of CBDC and its comparison to other forms of money. The second part of the thesis analyses the implementation of CBDC worldwide and compares approaches towards regulation in different countries. The final part of the paper focuses on the applicability of CBDC in the Czech Republic and evaluates the potential legal implications of their implementation. The thesis uses a comparative method to assess the suitability and conditions necessary for CBDC to become legal tender in the Czech Republic and evaluates the consequences of such a move, especially from a legal perspective. The aim of this thesis is to provide a comprehensive understanding of the legal aspects of CBDC and their potential role as a form of legal tender in the Czech Republic.
