Options of Debtors Protection against Abuse Reinsurance Bill

Abstract:

Tato diplomová práce se zabývá možnostmi ochrany směnečného dlužníka proti zneužití zajišťovací směnky. Práce si klade za cíl podrobně rozebrat prostředky ochrany směnečného dlužníka, které jsou součástí směnečné smlouvy a směnečné listiny. Detailně se věnuje problematice osamostatnění zajišťovací směnky a právním důsledkům vyplývajících z této skutečnosti pro dlužníky. Práce poskytuje směnečnému dlužníkovi doporučení, jak smluvně a směnečně upravit svá práva a povinnosti do okamžiku emise zajišťovací směnky včetně uvedení konkrétních ustanovení ve směnečné smlouvě a v textu směnky. Součástí této diplomové práce je také zpracování obrany v případě excesivního zneužití zajišťovací směnky směnečným věřitelem a rozbor problematiky námitek z vlastních vztahů.

Abstract:

This diploma thesis focuses on various possibilities of protection of the drawee against the breach of the bill of exchange. The main goal is to elaborately analyze the medium of protection of the drawee, which is a part of the exchange contract and deed. It observes the issues with the exclusion of the securing note and the legal consequences emerging from that for drawees. The thesis also provides the drawee with suggestions on how to alter his or hers rights and obligations by contract or by bill including the concrete regulations in the contract and in the text of the bill. Another part of this diploma thesis explores the defence in case of an excesive breach of the securing note by the creditor and it also resolves issues of relative objections.
