Criminal behavior of people under public curatorship

Abstract:

Diplomová práce se věnuje problematice veřejného opatrovnictví se zaměřením na oblast páchání trestných činů opatrovanců s tím, že zkoumá, zda jsou opatrovanci pachateli trestných činů nebo jsou spíše oběťmi, které jsou využívané jinými osobami pro páchání trestné činnosti. To je hlavním cílem diplomové práce. Dílčím cílem je zhodnocení funkčnosti veřejného opatrovnictví. V teoretické části je pozornost zaměřena nejprve na oblast výkonu veřejného opatrovnictví především na problematiku veřejného opatrovnictví, dále na specifikaci trestné činnosti opatrovanců a v neposlední řadě i postavení opatrovanců jako obětí trestných činů. Empirická část pomoci polostrukturovaného rozhovoru s veřejnými opatrovníky vyhodnocuje čtyři problematické oblasti výkonu veřejného opatrovnictví. Především důležitost vlivu přirozeného prostředí opatrovance na jeho vývoj v oblasti nezákonného chování, a to v kontextu možného zneužití třetí osobou. Dále ukazuje na příklady dobré praxe v oblasti preventivních programů vedoucích k zamezení páchání trestné činnosti opatrovanců. V neposlední řadě detekuje problematické oblasti, které vyplývají z výkonu opatrovnictví opatrovníky z řad fyzických osob a shrnuje i funkčnost systému veřejného opatrovnictví. Analyzuje i současné kontrolní mechanismy ve vztahu k výkonu opatrovnictví. Přínos diplomové práce je především v jejím podrobném vhledu do zkoumané problematiky, z kterého vyplývají legislativní i systematické nedostatky výkonu veřejného opatrovnictví.

Abstract:

This diploma thesis deals with the public curatorship and mainly focuses on criminal offences committed by people under curatorship. The main goal of this thesis is to investigate, whether people under public curatorship are direct perpetrators or rather victims, that are being used by other people to commit a crime. The partial goal is also to evaluate the functionality of the public curatorship. The theoretical part is firstly focused on the execution of the public curatorship, especially on current issues of this field. Further it specifies criminal activities of people under the public curatorship. Last but not least, it explores situations, when people under the public curatorship are victims of a crime. The empirical part evaluates four problematic areas of the public curatorship execution through the semi-structured interview with public curators. First and foremost, the importance of the natural environment and its influence on illegal behavior of people under public curatorship, as well in the context of potential misuse by third person. Further it highlights good practice examples, such as prevention programs that helps to reduce criminal activity of people under public curatorship. Last but not least, it detects problematic areas, resulting from the public curatorship executed by natural people and it summarizes the functionality of the public curatorship system. It also analyses current control mechanisms of the public curatorship execution. The main contribution of this diploma thesis consists in its detailed insight to the explored problems, which helps to identify legislative and system shortcomings of the public curatorship execution.
