Hierarchy of Contract Interpretation

Abstract:

Diplomová práce pojednává o hierarchii metod při interpretaci smluvního textu. V teorii i judikatuře převažují názory, že není možné stanovit hierarchii jednotlivých metod. Autorka na základě poznatků z teorie a judikatury vytváří vlastní pohled na hierarchii. V práci na ni nahlíží ve dvou rovinách. V první rovině rozebírá vliv vztahu výkladových cílů na posloupnost užití subjektivního a objektivního výkladu. Posléze ve druhé rovině rozebírá materiální vztah jednotlivých metod v rámci každého z těchto výkladů. Obě tyto roviny dohromady vytváří koncepci hierarchie při interpretaci smluvního textu.

Abstract:

The thesis deals with the hierarchy of interpretative methods with regards to contract interpretation. Czech legal theory and case law have adopted a negative approach to the hierarchy of interpretative methods. The author has her own opinion on the hierarchy of methods, which she created by generalising points from the theory and case law. The concept of the hierarchy is analysed on two levels. On the first level, the hierarchy is determined according to the criteria of the interpretative goals. On the second level, the thesis deals with the relationship of interpretative methods within subjective or objective interpretation. Both of these levels together create a compact approach on the hierarchy of methods of contract interpretation.
