Compensatory of the damage and its application in the criminal proceedings

Abstract:

Aggrieved party has several important procedural rights in the criminal proceedings. One of the most important is the right of aggrieved party to compensatory damages in the adhesive proceedings. This right is guaranteed by several international documents. The Czech legislator defines specific conditions in the Czech Criminal Procedure Order that must be met in order and then aggrieved party can set up a claim to compensatory damages. Then the criminal court decides about the legitimate interests of aggrieved party in the adhesion proceedings. Under the influence of principles of the restorative justice, the possibilities of aggrieved party for compensatory damages are expanding slowly due to the introduction of the new procedural institutions and the new special courses of proceedings. Even so, the regulation of the right to compensatory damages deserves the attention of experts from theory and practice.

Abstract:

Poškodený v trestnom konaní disponuje viacerými významnými procesnými právami. Jedným z najdôležitejších je právo poškodeného uplatniť si v adhéznom konaní nárok na náhradu škody. Uvedené právo poškodenému garantujú viaceré medzinárodné dokumenty. Český zákonodarca vymedzuje v českom trestnom poriadku konkrétne podmienky, ktoré musia byť splnené, aby si poškodený svoj nárok mohol uplatniť. Následne trestný súd o oprávnených nárokoch poškodených rozhoduje v adhéznom konaní, ktoré je vo fáze dokazovania totožné s trestným konaním. Pod vplyvom presadzovania princípov restoratívnej justície, v dôsledku zavádzania nových inštitútov a nových zvláštnych spôsobov konania sa možnosti poškodených dosiahnuť uspokojenie svojich nárokov pomaly rozširujú. I napriek tomu si úprava práva poškodených na náhradu škody zasluhuje pozornosť odborníkov z teórie i praxe.
