Economic and legal consequences of the establishment and holding property as a trust

Abstract:

Cílem této diplomové práce je rámcové porozumění a popis současného tuzemského prostředí točícího se okolo svěřenských fondů za účelem formulace hypotéz pro další výzkum. Důvodem vyhotovení této práce je poměrně nesourodý přístup a kontroverzní názory mezi odborníky na toto téma. Současně došlo v rámci výzkumné práce analýze vnitřních vztahů v rodinách zakladatelů těchto fondů včetně procesu samotného založení fondu. V rámci praktické části bylo uskutečněno 6 hloubkových rozhovorů s experty v tomto oboru, kteří se zabývají zakládáním a správou svěřenských fondů. Rozhovory byly vedeny formou rozhovoru zaměřeného na problém za účelem tvorby teorie. V rámci analýzy výsledků došlo k identifikaci problémů spojených s vyčleněním majetku do správy fondu a zejména komunikaci souvisejících informací. Současně byl analyzován názor expertů na osobu svěřenského správce a cíle zakladatelů, přičemž tyto domněnky byly následně zapracovány do modelu ideálního svěřenského správce. V neposlední řadě došlo k odhalení názoru expertů na současné legislativní a ekonomické prostředí pro tuzemské svěřenské fondy.

Abstract:

The aim of this Master´s thesis is a partly understanding a description of the current local environment revolving around trusts (in Czech: Svěřenský fond) in order to formulate hypotheses for further research. The reason for creating this work is a relatively inconsistent approach and controversial opinions among experts on this topic. At the same time, the research work analyzed the internal relations in the families of the trust founders, including the process of establishing the trust itself. Within the practical part, 6 in-depth interviews were conducted with experts in this field who deal with the establishment and management of trust. The interviews were conducted in the form of a problem-centered and theory-generating expert interview. As a part of the analysis of the results, problems were identified with the allocation of assets to the trust, in particular, the communication of related information. At the same time, the opinion of experts on the person of the trustee and the goals of the founders were analyzed, while these assumptions were subsequently incorporated into the model of the ideal trustee. Last but not least, the opinion of experts on the current legislative and economic environment for local trusts was revealed.
