Perspectives and Relevant Legal Regulations of the Criminal Liability of Corporation in the Czech Republic

Abstract:

Tato diplomová práce se zabývá problematikou možného zavedení institutu trestní odpovědnosti právnických osob do českého právního řádu. Práce obsahuje nejprve stručné vysvětlení pojmu kolektivní trestní odpovědnost a dále krátký historický exkurs tohoto institutu. V další části se práce soustředí na zahraniční právní úpravy, v kterých byl tento institut přijat nebo byl naopak zamítnut. Pozornost je dále věnována otázce potřebnosti zavedení trestní odpovědnosti právnických osob do českého právního řádu, včetně argumentů pro a proti zavedení, srovnání správního a soudního trestání či problematiky mezinárodních dokumentů zabývajících se otázkou efektivního sankcionování právnických osob. V následující kapitole se pak práce zabývá jednotlivými podmínkami případné právní úpravy a v závěru práce obsahuje zamyšlení nad perspektivou takové právní úpravy v českém právním prostředí. Není také opomenuta charakteristika nepřijatého návrhu zákona o trestní odpovědnosti právnických osob z roku 2004.

Abstract:

This thesis deals with the problem of corporate criminal liability and with the problem of the relevant implementation of this institute to the Czech legal order. The first part of the thesis focuses on the construct of the corporate criminal liability and then on the history background of this liability. The next part is dedicated to the ways of regulations of this problem in other states. Next chapter discusses the question, if this kind of regulation is necessary in Czech legal order at all. In next chapter the attention is dedicated to the conditions of the relevant legal regulations of corporate criminal liability. At the end of the thesis there are described the perspectives of this kind of legal regulations in Czech legal order. The thesis contains the characteristic of the bill, which was declined in 2004.
