Influence of the debt relief amendment and Lex covid laws on debt relief legislation

Abstract:

Tato diplomová práce se zabývá problematikou novelizace právní úpravy oddlužení, a to hned několika zásadními novelami. Za tímto účelem je rozdělena do pěti základních kapitol. První kapitola je věnována vymezení pojmu oddlužení a jeho historickému vývoji, který vedl k aktuální podobě tohoto institutu. Druhá kapitola je zacílena na oddlužovací novelu insolvenčního zákona účinnou od 1. 6. 2019 a na porovnání rozdílů právní úpravy institutu oddlužení před a po účinnosti této novely a její aplikaci v praxi. Třetí kapitola pojednává o rozdílech v nejpodstatnějších aspektech insolvenčního řízení, zejména o zrušení 30 % hranice splnění závazků v oddlužení a dalšími většinou zmírněním předchozí právní úpravy, například formy zkráceného insolvenčního řízení. Ve čtvrté kapitole jsou rozebrány jednotlivé aspekty vlivu a trvalosti změn způsobených přijetím zákonů Lex Covid I. a Lex Covid II. Poslední kapitola je úvahou nad aktuálními změnami právní úpravy oddlužení a nad budoucím směřováním právní úpravy dané problematiky. Na základě všech učiněných poznatků v této diplomové práci je závěrem navržena úprava de lege ferenda. Hlavním cílem práce je srovnání právních úprav institutu oddlužení před a po oddlužovací novele, ale současně i vliv a trvalost změn způsobených přijetím zákonů Lex Covid I. a Lex Covid II. Předposledním bodem v rámci poslední kapitoly této diplomové práce je takzvaná "transpoziční novela" a její vliv na právní úpravu oddlužení. Výstupem této práce je ucelený pohled na institut oddlužení s jeho klady i zápory.

Abstract:

This thesis deals with the issue of amendments to the legal regulation of debt relief through several major amendments. For this purpose, it is divided into five essential chapters. The first chapter is devoted to the definition of the concept of debt relief and its historical development, which led to the current form of this institute. The second chapter focuses on the insolvency amendment to the Insolvency Act effective as of 1 June 2019 and on the comparison of differences in the legal regulation of the insolvency institute before and after the amendment and its application in practice. The third chapter discusses the differences in the most important aspects of the insolvency procedure, for example, the removal of the 30 % limit for the fulfilment of liabilities in the insolvency procedure and other softenings of the previous legislation, such as the form of the shortened insolvency procedures. The fourth chapter discusses various aspects of the impact and permanence of the changes brought about by the acceptance of Lex Covid I. and Lex Covid II. The last chapter is a reflection on the recent changes to the legal regulation of insolvency and the future direction of the legal regulation of the issue. On the basis of all the observations made in this thesis, a de lege ferenda regulation is suggested at the end of the thesis. The main purpose of the thesis is to compare the legal regulation of the insolvency institute before and after the insolvency amendment, but also the impact and permanence of the changes caused by the acceptance of Lex Covid I. and Lex Covid II. The second to last point in the last chapter of this thesis is the so called "transposition amendment" and its impact on the debt relief legal regulation. The result of this thesis is a comprehensive view of the institution of insolvency with its pros and cons.
